3. Nature de la relation

  • Free Plan no cancellation or refund applicable.
  • Standard and Premium Plans:
  • Subscriptions are billed in Canadian dollars (CAD) and include applicable taxes.
  • (GST/QST).
  • Plans renew automatically unless canceled before the renewal date.
  • Professionals can cancel their subscription at any time via their dashboard. Cancellation takes effect at the end of the current billing period.
  • No refunds are granted for a subscription period already started, except in the event of a technical failure attributable to MentalConnect.ca.

4. Achats sur le marketplace

1. Objet et parties

Le présent Accord (« Accord ») définit les conditions selon lesquelles un Professionnel (prestataire autorisé) ou un Vendeur (fournisseur de produits/ressources) utilise Mental Connect.ca (la << Plateforme >>), exploitée par SC Nature & Commerce inc. (« Nous/Notre »), afin de :

  1. publier une annonce professionnelle / un profil, et/ou
  2. vendre des produits ou services via le Marketplace.

En créant un compte professionnel, en publiant des services/produits ou en cliquant sur « J’accepte »>, vous acceptez le présent Accord et toutes les politiques qui y sont intégrées par référence.

2. Définitions

  • Professionnel: personne physique ou morale autorisée (psychologue, travailleur social, psychothérapeute, etc.) offrant des services liés à la santé mentale.
  • Vendeur: Professionnel ou organisation vendant des produits numériques ou physiques via la Plateforme.
  • Acheteur utilisateur qui achète auprès d’un Vendeur via la Plateforme.
  • Services: prestations (consultation, counseling, coaching, psychoéducation, etc.).
  • Produits articles physiques ou numériques (ex. livres, e-books, ateliers, formations en ligne).

3. Nature de la relation

  • La Plateforme agit uniquement comme intermédiaire. Nous ne sommes ni une clinique, ni un fournisseur de soins, ni un service d’urgence.
  • Sauf indication contraire expresse, vous êtes le commerçant responsable de vos produits/services, de leur conformité et des taxes.
  • Aucune relation d’emploi, de partenariat ou de mandat n’est créée par cet Accord.

4. Admissibilité et inscription

Vous déclarez et garantissez que :

  • Vous avez 18 ans ou plus et la capacité juridique de contracter.

5. Normes professionnelles et conformité

  • Interdits: substances contrôlées, dispositifs médicaux non autorisés, produits dangereux, allégations médicales non prouvées, produits contrefaits.
  • Responsabilités :
  • Exactitude des annonces (titre, description, prix, taxes, délais).
  • Sécurité et conformité des produits (étiquetage, normes de consommation).
  • Livraison (physique ou numérique).
  • Respect de la Politique de remboursement et d’annulation.

7. Prix, taxes et facturation

  • Les prix doivent être affichés en dollars canadiens (CAD).
  • Vous êtes responsable de percevoir et remettre les taxes applicables (TPS/TVQ/HST) sauf si la Plateforme agit à titre de facilitateur de marché.
  • Des factures conformes doivent être fournies aux acheteurs.

8. Paiements, commissions et règlements

  • Les paiements sont traités via des prestataires sécurisés (Stripe, PayPal).
  • Nous prélevons une commission et/ou des frais fixes, indiqués dans votre tableau de bord.
  • Les règlements sont effectués selon l’échéancier prévu, sous réserve des délais de règlement bancaire.
  • Nous pouvons retenir des fonds en cas de litige, fraude ou chargeback.

9. Service client et litiges

  • Vous devez répondre aux demandes des clients dans un délai de 2 jours ouvrables.
  • Les litiges doivent être réglés de bonne foi. La Plateforme peut agir en médiateur mais n’est pas responsable du résultat final.

10. Données personnelles et marketing

  • Vous devez traiter les données des utilisateurs conformément à la Loi 25 (Québec) et à la LPRPDE.
  • Vous ne pouvez utiliser les données des clients qu’aux fins de la commande et du service.
  • Aucune sollicitation commerciale sans consentement exprès (LCAP – Loi canadienne anti- pourriel).

11. Propriété intellectuelle

  • Vous garantissez que vos contenus/produits n’enfreignent pas les droits de tiers.
  • Vous nous accordez une licence limitée pour afficher et promouvoir vos annonces sur la Plateforme.

12. Suspension et résiliation

Nous pouvons suspendre ou supprimer votre compte en cas de non-respect de cet Accord ou des lois applicables. Vous pouvez fermer votre compte en tout temps, mais vos obligations (taxes, remboursements, commissions) subsistent.

13. Responsabilité et indemnisation

  • La Plateforme est fournie « telle quelle » sans garanties supplémentaires.
  • Notre responsabilité est limitée aux frais que vous nous avez versés au cours des 3 mois précédant la réclamation.
  • Vous acceptez d’indemniser et dégager de toute responsabilité MentalConnect.ca en cas de dommages, pertes, réclamations ou frais liés à vos activités, produits ou services.

14. Modifications

Nous pouvons modifier cet Accord en publiant une version mise à jour avec une nouvelle date. Votre utilisation continue vaut acceptation.

15. Droit applicable et juridiction

Cet Accord est régi par les lois du Québec et du Canada. Tout litige relève des tribunaux du Québec (district judiciaire du siège social).
